Terms of Use

These Terms govern the access.loan website, Access-controlled business contact and verification forms, the public demonstration, and related evaluation materials (the "Public Services").

The Public Services are for business evaluation. They do not provide consumer credit and do not govern a lender's customer environment.

1. Acceptance and Eligibility

By clicking "Verify and Start Demo," selecting an "I agree" control, or otherwise affirmatively accepting these Terms when presented before access to the interactive demo, you agree to these Terms. If you use the Public Services for an organization, you represent that you are authorized to bind it. You must be at least 18 and use the Public Services only for lawful business evaluation or informational purposes. Merely viewing publicly available marketing pages does not constitute acceptance of provisions requiring affirmative contractual assent. If you do not agree, do not use the interactive demo.

2. Access's Role

Access Loan LLC ("Access," "we," "us," or "our") provides mortgage technology to licensed lenders and other businesses. Access is not a lender, creditor, mortgage broker, loan servicer, real estate broker, financial adviser, or credit decision-maker. Through the Public Services, Access does not offer, arrange, underwrite, approve, deny, fund, close, or service a loan.

Nothing on the Public Services is an offer or solicitation of credit, a loan application, a prequalification or preapproval, a rate lock, a credit decision, a loan commitment, or legal, compliance, tax, mortgage, or financial advice. No credit report is obtained through the public demo.

3. Public Demo

Demo gate. To request or enter the demo, you may provide real business contact information, complete one-time-passcode verification, and choose whether to receive Access marketing. Access may use your gate contact and company information to personalize the walkthrough and prefill fields displayed as borrower contact fields.

Mortgage walkthrough. The walkthrough combines synthetic mortgage scenarios with real business contact and company information provided at the demo gate. Prefilled borrower contact fields are demonstrations only and do not create or submit a loan application. Address autocomplete is provided through Google Maps Platform and may transmit address queries and related technical information to Google. Other walkthrough inputs and selected filenames may remain in browser storage, and selected file contents are not uploaded. The walkthrough does not call live lender, pricing, credit, valuation, title, document, artificial intelligence, CRM, or loan-origination systems.

Use only permitted demo data. You may enter your own business contact information requested at the demo gate and ordinary address information solely to use demo autocomplete. Do not enter information about another real applicant, borrower, consumer, or transaction; Customer Data; customer-confidential or production information; credentials; consumer reports; Social Security numbers; government identification; financial account information; or real documents into the walkthrough. All rates, products, payments, eligibility results, documents, and workflow outcomes are illustrative and may not be used for a loan, credit, underwriting, compliance, legal, or financial decision.

4. Customer Environments

Customer-branded sandboxes, implementations, portals, and production environments ("Customer Environments") are available only under a separate written agreement. That agreement, together with the customer's own terms, privacy notices, disclosures, and authorizations, governs the Customer Environment. A borrower or other end user does not become a party to these Terms solely by using a Customer Environment.

Each party is responsible for what it controls. The customer lender controls its products, pricing, eligibility and underwriting rules, disclosures, authorizations, permissible purposes, communications, credit decisions, notices, licensing, and regulated conduct. Access is responsible for Access-controlled technology, personnel and subprocessors, security obligations, and implementation of customer-approved requirements, as stated in the customer agreement. Access does not guarantee independent third-party services or customer-controlled configurations.

Unless the customer agreement states otherwise, the customer's designated loan-origination system is the official system of record. Feature-specific terms govern consumer-report data, AI-assisted tools, and integrations; Access does not make final credit decisions.

5. Information You Provide

You will provide accurate business information and only information you are authorized to provide. You retain your rights in materials you submit. You authorize Access and its service providers to process them only as needed to provide the Public Services, respond to you, maintain security, comply with law, and enforce these Terms, subject to our Privacy Policy. Customer Data is governed by the applicable customer agreement.

6. Accounts and Security

If we issue a code, access link, credential, or demo session, keep it secure and do not share it except with authorized personnel. Notify us promptly of suspected misuse. We may suspend or restrict access where reasonably necessary to address misuse, fraud, a security or legal risk, or a violation of these Terms.

7. Acceptable Use

Subject to these Terms, Access grants you a limited, revocable, nonexclusive, nontransferable right to use the Public Services for internal business evaluation. You may not:

  • violate law, a contract, or another person's rights;
  • use the walkthrough with prohibited data or for a real transaction;
  • misrepresent your identity, affiliation, authority, or information;
  • access another person's account, data, documents, or environment without permission;
  • interfere with the Public Services, bypass controls, test security without authorization, or introduce malicious code;
  • scrape, crawl, automate access, or harvest data without written permission;
  • reverse engineer or attempt to derive source code, algorithms, workflows, or proprietary logic;
  • copy, resell, sublicense, or commercially exploit the Public Services or their output;
  • publish competitive benchmark results without our written consent; or
  • use the Public Services for discriminatory, predatory, abusive, deceptive, or unlawful activity.

8. Communications

By providing contact information, you authorize service communications about your request, verification, demo, meeting, account, support, security, and legal notices. Marketing communications are sent as permitted by law and according to your choices. You may unsubscribe from marketing emails. If you separately consent to marketing texts, message and data rates may apply, consent is not a condition of purchase, and you may reply STOP to opt out. We may still send nonmarketing messages.

These Terms do not provide consent for a customer lender to send borrower marketing or deliver mortgage disclosures electronically.

9. Intellectual Property and Feedback

The Public Services and related software, designs, content, documentation, workflows, and marks are owned by or licensed to Access and are protected by law. Except for the limited right granted above, no rights are granted to you. Do not use Access names, logos, domains, or marks without written consent.

If you provide suggestions or feedback, you grant Access a worldwide, perpetual, irrevocable, royalty-free right to use it without restriction or compensation. We will not publicly identify you as the source without permission.

10. Third-Party Links and Services

The Public Services may link to or use third-party sites or services. Their terms and privacy policies apply. Address autocomplete in the Public Demo is provided by Google Maps Platform and is subject to the Google Maps Platform Terms and Google Privacy Policy. Access does not control or endorse independent third parties and is not responsible for their content, availability, or conduct.

11. Privacy

Our Privacy Policyexplains how we handle personal information through the Public Services. Processing in Customer Environments is governed by the applicable customer agreement and the customer's privacy notices.

12. Availability and Changes to the Public Services

We may modify, suspend, limit, or discontinue any part of the Public Services. We do not guarantee uninterrupted, error-free, or continuous availability. These statements apply only to the Public Services and do not alter an express commitment in a customer agreement.

13. Disclaimers

To the fullest extent permitted by law, the Public Services are provided "as is" and "as available." Access disclaims all express and implied warranties, including merchantability, fitness for a particular purpose, title, noninfringement, accuracy, and completeness. We do not warrant that the Public Services are suitable for production use or for a lending, compliance, legal, or business decision. These disclaimers do not alter an express warranty in a customer agreement.

14. Limitation of Liability

To the fullest extent permitted by law, Access and its officers, employees, agents, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or enhanced damages, or for lost profits, data, goodwill, or business interruption, arising from the Public Services or these Terms.

Their total aggregate liability arising from the Public Services or these Terms will not exceed the greater of $100 or the amount you paid Access for the Public Services during the 12 months before the event giving rise to the claim. Nothing limits liability that cannot lawfully be limited, and a customer agreement may state different terms for paid services.

15. Indemnification

You will defend and indemnify Access and its officers, employees, and agents against a third-party claim to the extent caused by your unlawful use of the Public Services, material breach of these Terms, or submission of material you lacked authority to provide. Access will give prompt notice, allow you to control the defense with reasonably acceptable counsel, and provide reasonable cooperation. You may not settle a claim in a way that admits fault by or imposes a nonmonetary obligation on Access without our consent.

16. Governing Law and Disputes

Before filing a claim, contact us and provide a reasonable opportunity to resolve it informally. Maryland law governs these Terms, without regard to conflict-of-law rules. Any court proceeding must be brought in the state or federal courts located in Baltimore, Maryland, and each party consents to their jurisdiction and venue.

TO THE FULLEST EXTENT PERMITTED BY LAW, EACH PARTY WAIVES TRIAL BY JURY.

17. Changes to These Terms

We may update these Terms prospectively. The effective date above identifies the current version. If a change is material, we will provide reasonable notice through the Public Services or another appropriate channel and may require affirmative reacceptance before continued access to the interactive demo. Changes will not retroactively alter accrued claims.

18. General

These Terms and any additional terms presented for a Public Service are the entire agreement about the Public Services. If a provision is unenforceable, the rest remains effective, and failure to enforce is not a waiver. You may not assign these Terms without consent; Access may assign them in a corporate transaction. No agency, partnership, or fiduciary relationship is created. Except for the persons and entities expressly protected under Sections 14 and 15, who are intended third-party beneficiaries of those sections, these Terms create no third-party-beneficiary rights. Provisions that should survive termination will survive.
